Sen. Hawley’s Framework:

Bad for Businesses.

Dangerous for Workers.

Sen. Hawley’s proposed framework is more of the same Big Government interference that limits productivity and restricts opportunity for hardworking Americans.

Empowers Government Interference

  • Imposes government-mandated contract terms on employers and employees, stripping away their rights to freely negotiate workplace conditions
  • Eviscerates “voluntary agreement,” a primary tenet of U.S. labor law

Restricts First Amendment Rights

  • Bans so-called “captive audience meetings” held by employers that give workers and employees the chance to clear the air about union claims
  • Prevents businesses from freely discussing the potential negative consequences of government-mandated labor contracts with workers

Mandates
Ambush Elections

  • Mandates representation elections be held within 20 business days after a union files a petition, resulting in “backdoor organizing”
  • Silences debate on unionization and results in workers being less informed about the pros and cons of union representation before voting

Prohibits Productivity Metrics

  • Includes a provision prohibiting employers in the warehousing industry from using productivity metrics
  • Hints at plans to regulate ergonomics in the workplace — something a strong bipartisan majority of Congress once invalidated in the first-ever use of the Congressional Review Act
